After trying all of your suggestions here is a modem log.

Ok guys, this is after selecting compression and adding S32=34. What do you think now? Also there a high
pitch noise just before the two V.90 dongs. I am not sure what a double handshake is Richard but if it means
a couple of pings or something after the v.90 bong it does.

Kelly, is there -any- noise on your phone line?

Might pick up the phone reciever, dial 1 and then listen very closely to see if you hear any crackling, pops or a hum (may be almost inaudible) or if there's any crosstalk (faint dialing sounds or distant voices).

I can't really hear anything, but my daughters say there is kind of a fuzzy sound. Maybee, maybee not.
I have had my IPS who is also my phone provider check it out and they say I should be able to get a 56k connection. I have also sent them modem logs pointing out the SNR of .1. It has been at least one month and I have submitted the log files to them twice. Not sure how accurate modem logs are.

Well, next step would be to take the computer to a friend's home, one that you know is getting a 56K connection and try a connection to your ISP using their phone line. This will let you know very quickly if the problem is with the modem/modem setup or with your phone line.

Seeing the 21.6k upstream rate, and retrains, I would suggest trying a different ISP - if not via an actual account, at least test calls.
