I connect at 7.2-12kbs. I've updated drivers from Agere site and I've tried the modem on different phone lines and it's the same. Any idea as to what else I could try?

If modem connects at those rates on more than one computer/phone line, and other modems don't have that problem it's a pretty good sign that the modem is bad.
