I have a Ess Es56h-PI Data Fax Voice modem. When Win XP queries the modem under the diagnostics tab in the control panel the response to the command AT#CLS=? is COMMAND NOT SUPPORTED. Does this mean my modem is not "voice" capable, or is it a driver issue

All modems don't support all commands -
Windows diagnostic tab/query modem issues commands to modem irregardless of whether the command is supported or not.
So the answer to your questions could be no and no.
